These terms govern your use of LocalPacificBeach.com (the “Site”). By accessing or using the Site you agree to them in full. If you do not agree, please do not use the Site.
Terms of Use
The Site is an independent, editorial guide to Pacific Beach in San Diego, California, provided for general informational and entertainment purposes only. You may view and share the Site for personal, non-commercial use. You agree not to: scrape, harvest, or bulk-download content; misuse or overload the Site or its AI assistant; submit unlawful, defamatory, infringing, harassing, or misleading content; attempt to gain unauthorized access to any system; or use the Site in violation of any applicable law.
We may modify, suspend, or discontinue any part of the Site at any time, without notice and without liability, and we may remove content or block access at our discretion.
General Disclaimer
ALL CONTENT ON THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.
Hours, prices, menus, events, parking rules, closures, and conditions change frequently and may be inaccurate, incomplete, or out of date. Always confirm directly with the business, venue, or official government source before you go or make plans. Nothing on the Site is legal, financial, medical, real-estate, travel-safety, or professional advice, and no content should be relied upon as such.
AI Assistant (Sandy AI) Disclaimer
“Sandy AI” is an automated assistant powered by third-party large language models. Its responses are generated by software, are not reviewed by a human before you see them, and may be inaccurate, outdated, incomplete, or entirely wrong (“hallucinated”). Sandy AI does not provide professional advice of any kind and does not speak on behalf of any business, venue, or public agency.
Do not rely on AI-generated answers for safety, health, legal, financial, emergency, transportation, or travel decisions. Verify independently. Do not submit confidential, sensitive, or personal information to the assistant. Conversations may be processed by third-party AI providers subject to their own terms and privacy practices, and may be logged for abuse prevention and quality purposes.
Weather, Surf & Safety Disclaimer
Weather, tide, surf, water-temperature, and related conditions displayed on the Site come from third-party data sources (including Open-Meteo) and are provided for general interest only. They are not official forecasts or safety advisories and may be delayed, estimated, or wrong.
Never make ocean-entry, swimming, surfing, boating, driving, or other safety decisions based on this Site. Consult the National Weather Service, NOAA, San Diego Lifeguard Services, and posted beach signage. Ocean activities carry inherent risks of serious injury or death; you assume all such risks. In an emergency, call 911.
Third-Party Businesses & Links
References to restaurants, bars, shops, events, rentals, and other businesses are editorial mentions. They are not endorsements, certifications, recommendations of fitness or safety, or guarantees of quality, licensing, availability, or price. We are not a party to any transaction between you and any third party, and we are not responsible for their goods, services, conduct, or content.
The Site may contain links to third-party websites we do not control. We are not responsible for their content, accuracy, privacy practices, or availability. Some links may be affiliate, sponsored, or advertising links; where required by the FTC, such relationships are disclosed. Compensation never guarantees a favorable mention.
No Affiliation
LocalPacificBeach.com is an independent website. It is not affiliated with, endorsed by, sponsored by, or operated by the City of San Diego, San Diego County, the State of California, any lifeguard, police, or public agency, any tourism board, or any business, brand, or venue mentioned on the Site. All trademarks, service marks, and trade names belong to their respective owners and are used for identification and editorial purposes only, consistent with nominative fair use.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE OPERATOR AND ITS OWNERS, OPERATORS, CONTRIBUTORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, ANY AI-GENERATED CONTENT, ANY THIRD-PARTY DATA, OR ANY BUSINESS, VENUE, OR ACTIVITY REFERENCED ON THE SITE — WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you; in that case our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless the Site, its owners and operators from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these terms, or your violation of any law or third-party right.
Intellectual Property & Copyright
All original text, design, graphics, and code on the Site are owned by the Site operator and protected by copyright and other laws. You may not reproduce, republish, or create derivative works from Site content without written permission, except for brief quotation with attribution and a link.
If you believe content on the Site infringes your copyright or trademark, send a notice through our contact form (choose “Legal, copyright or takedown”) including: identification of the work, the exact URL of the material, your contact information, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and that you are authorized to act, and your electronic signature. We remove or disable material that is properly shown to be infringing.
Privacy Policy
What we collect. We collect only what you give us or what is technically necessary: (1) information you enter in the contact form — your name, email address, topic, optional subject, message, the page you submitted from, and your agreement to these terms; (2) messages you type to the AI assistant; and (3) standard technical data such as IP address, browser type, and request logs, generated automatically by our hosting and security infrastructure.
How we use it. To respond to inquiries, correct or improve content, operate and secure the Site, prevent abuse and spam, and comply with legal obligations. We do not sell or rent your personal information, and we do not share it for cross-context behavioral advertising.
Who processes it. Service providers acting on our behalf, including our hosting, database, and AI-model providers, process data solely to deliver these services. We may disclose information when required by law or to protect legal rights and safety.
Retention & security. Contact submissions are kept only as long as needed for the purposes above and then deleted. We use reasonable technical and organizational safeguards, but no method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.
Your choices. You may request access, correction, or deletion of information you submitted by using the contact form. We may need to verify your request before acting on it.
Children's Privacy
The Site is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided information, contact us through the form and we will delete it.
California Privacy Rights
California residents may request to know what personal information we have collected about them, request deletion or correction, and are entitled not to be discriminated against for exercising these rights. We do not sell or share personal information as those terms are defined by the CCPA/CPRA. Submit requests through the contact form; we respond within the timeframes required by law.
Accessibility Statement
We are committed to making the Site usable by everyone and work toward conformance with WCAG 2.1 Level AA. The Site includes an accessibility toolbar with text sizing, high contrast, readable font, link underlining, focus highlighting, motion reduction, and a large cursor. Accessibility is an ongoing effort and some content — particularly third-party data and AI-generated responses — may not be fully conformant at all times.
If you encounter a barrier, please tell us through the contact form (choose “Accessibility issue”), describing the page and the problem. We will work to provide the information in an accessible alternative.
Governing Law & Disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You agree that any dispute arising out of or relating to the Site or these terms shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to their personal jurisdiction and venue. To the extent permitted by law, claims must be brought within one (1) year after the claim arises, and only on an individual basis — not as a class or representative action. If any provision is found unenforceable, the remaining provisions remain in full effect.
Changes to These Terms
We may update these terms at any time. Changes take effect when posted, and the effective date above will be revised. Your continued use of the Site after changes are posted means you accept the updated terms.
